These Terms of Service ("Terms") govern your use of AI-RentalCarCheck ("RentCheck", "the app"), published by InflectionPeak ("we", "us", "Distributor"). By creating an account, tapping agree/continue, or using the app, you agree to these Terms and our Privacy Policy.

1. What the app is

AI-RentalCarCheck is a consumer software tool that only assists you in inspecting and documenting a rental vehicle — mainly at pickup and return. Core features may include a manual checklist, photos and optional walk-around video, license-plate entry or on-device scan, optional GPS attachment, optional cloud AI suggestions, cloud sync when signed in, PDF export, and car history keyed by license plate.

The app is not a lawyer, insurer, notary, expert witness, rental company, or court. Nothing in the app is legal advice.

2. Assistance only — never legal proof for a claim

The app, its reports, photos, videos, checklists, GPS data, AI findings, timestamps, PDFs, and any other output are solely an optional aid for your personal notes. They are not — and must never be treated as — conclusive, sufficient, or court- or insurer-ready proof for any damage claim, dispute, chargeback, grievance, complaint, or proceeding against a rental company, insurer, court, authority, or any third party.

Official inspections, rental-company procedures, and professional advisors remain solely authoritative.

3. Your sole responsibility

You alone are fully responsible for walking around the vehicle, checking every relevant area, verifying every photo, video, note, and AI suggestion, and deciding what to sign or report. If you rely on this app when making a claim or complaint, you do so entirely at your own risk.

4. AI and automation can be wrong

AI-assisted features (including damage detection, license-plate reading, vehicle identification, and the assistant) can miss damage, invent findings, misread plates or details, and otherwise fail. Treat every AI result as an unverified suggestion that you must confirm yourself.

5. License plates and personal data

License plate numbers you enter or scan are used as a primary vehicle identifier for inspections, lookup, and car history. As described in our Privacy Policy, we treat license plates as personal data under the GDPR in this app's context. You must only process plates and related inspection data lawfully and in accordance with applicable privacy laws.

6. Accounts, sync, and cloud AI

Some features require an account and internet access. When signed in, inspection data may sync to our cloud providers. If you enable cloud AI, selected photos or video frames may be sent to our servers and processed by third-party models (for example Google Gemini). Transmission is over the internet. Do not use cloud AI if you do not accept that transfer.

7. Subscriptions

Premium features may require a paid subscription purchased through the Apple App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple ID subscription settings. Refunds are handled according to Apple's policies.

8. Acceptable use

You agree not to:

• Misuse the app or attempt unauthorized access to systems or other users' data
• Use the service for unlawful purposes
• Reverse engineer protected components where prohibited by law
• Represent app outputs as official or legally conclusive proof

9. Disclaimer of warranties

The app and all related services are provided "AS IS" and "AS AVAILABLE," without any warranty of any kind, whether express, implied, or statutory — including merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability — to the maximum extent permitted by applicable law.

10. No claims against the Distributor (limitation of liability)

To the maximum extent permitted by applicable law, you agree that the publisher, developers, operators, affiliates, licensors, and distributors of AI-RentalCarCheck (together, the "Distributor") have no liability to you or anyone else for any loss, cost, fine, claim, grievance, complaint, dispute, or damages of any kind (including lost claims against a rental company or insurer, lost data, or consequential losses) arising out of or relating to your use of — or inability to use — the app or its outputs.

You waive, release, and agree not to assert any claim, grievance, demand, or proceeding against the Distributor based on the app's content, omissions, AI errors, data processing by third parties (including Google Gemini via our servers), sync, storage, or downtime — except where such a waiver is prohibited by mandatory consumer-protection law (for example liability for intent or gross negligence where it cannot be excluded).

Where liability cannot be fully excluded, it is limited to the greater of (a) the amounts you paid for the app/subscription in the three (3) months before the claim or (b) EUR 50, to the maximum extent permitted by law.

11. Changes

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms. Material changes may also be reflected by an in-app re-acceptance of the disclaimer where we require it.
